Title IX Coordinator (Administrator II) REPOSTED WITH REVISED REVIEW DATE

Overview:
Reporting to the Vice President for Administration, the Title IX Coordinator will have primary responsibility to monitor, supervise and oversee all campus-wide implementation of and compliance with Title IX, including Athletics, and all related California State University Executive Orders. Such efforts will include coordination of training, education, communications and administration of complaint procedures for faculty, staff, students and third parties. The Title IX Coordinator has authority across all campus­-based programs (e.g., Athletics, Human Resources, Academic Affairs, Student Affairs, Housing, University Police to monitor, oversee, and ensure implementation of Title IX, including compliance with VAWA/Campus SaVE Act; other legislative actions; and all other relevant OCR directives.
The Title IX Coordinator collaborates with the Discrimination, Harassment and Retaliation (DHR) Administrator to work collaboratively with campus divisions to lead the University's efforts to prevent discrimination, harassment, and retaliation, including sexual harassment, sexual violence, and intimate partner violence.
Other Position Declarations:

∙ This is a full-­time management position covered by the California State University Management Personnel Plan. Under this plan, employees are subject to management reviews and serve at the pleasure of the University President of that campus.
∙ The person holding this position is considered a "mandated reporter" under the California Child Abuse and Neglect Reporting Act and is required to comply with the requirements set forth in CSU Executive Order 1083 as a condition of employment.
∙ This position may be a "designated position" in the California State University's Conflict of Interest Code. The successful candidate accepting this position may be required to file Conflict of Interest forms subject to the regulations of the Fair Political Practices Commission.

Compensation:
The salary is competitive and is negotiable depending on the strength of qualifications. This is a CSU Management Personnel Plan (MPP) position with an attractive benefits package which includes but is not limited to: a vacation accrual rate of 16 hours per month; 12+ paid holidays; excellent choice of medical, dental and vision insurance, long term disability coverage, life insurance; and retirement benefits.

Position Summary:
Specific responsibilities include administration and oversight of Title IX, as it relates to complaint investigation; athletic programs; developing and implementing effective and compliant education and training programs; and monitoring and ensuring ongoing campus compliance with Title IX and other sex discrimination, sexual harassment, dating and domestic violence, stalking, and other sexual violence regulations.

Complaints and Investigation
∙ Provide the victim with reasonable interim remedies, if requested by the victim, regardless of whether the victim chooses to report the conduct to campus police or local law enforcement;
∙ Meet with the victim on a regular basis to determine what steps (interim and ultimate) should be taken to protect him/her from any hostile or unsafe environment resulting from Sex Discrimination, Sexual Harassment, Sexual Violence, Domestic Violence, Dating Violence, and/or Stalking, and ensure that such steps are taken;
∙ Oversee all complaints of Sex Discrimination, Sexual Harassment, Sexual Violence, Domestic Violence, Dating Violence, and/or Stalking, including related investigations, interim and/or ultimate remedies, resolution, and coordination with disciplinary decision­-makers regarding any resulting discipline against the accused;
∙ Provide written explanation of rights and options to all students, employees or third parties who complain to the University of being a victim of Sexual Violence, Domestic Violence, Dating Violence, or Stalking, whether the offense occurred on or off campus;
∙ Assist and provide the victim with reasonable remedies as requested by the victim throughout the reporting, investigative, and disciplinary processes, and thereafter, regardless of whether the victim chooses to report Sexual Violence to campus or local police;
∙ Assist victims in accessing available victim advocacy, academic support, counseling, disability, medical/health or mental health services, and legal assistance both on and off campus;
∙ Provide security and support, which could include issuing a no­-contact order, helping arrange a change of campus-based living or working arrangements or course schedules (including for the perpetrator pending the outcome of the investigation) or adjustments for assignments, tests, or work duties;
∙ Inform victims of their right to report a crime to University of local police – and provide victims with assistance if desired; and Follow up with victims to determine whether any retaliation or new incidents of Sexual Harassment, Sexual Violence, Domestic Violence, Dating Violence, or Stalking have occurred.

Athletics
∙ Oversee compliance of Title IX regulations within the university's Department of Athletics and work closely with senior staff to ensure monitoring of efforts to provide equitable, intercollegiate athletics experiences.
∙ Provide advice and counsel to the President, Director of Athletics and Vice President for Administration on all matters related to Title IX compliance, potential violations and recommend remedial action.
∙ Serve as university spokesperson for all Title IX complaints filed with the Office of Civil Rights, including athletics.
∙ Work closely with Athletics Department senior staff in ensuring timely submittal of the Equity in Athletics Disclosure
∙ Act (EADA), participation squad lists and the NCAA financial report;
∙ Serve as an Ad Hoc member of the Fresno State Athletics Advisory Council and chair the university's Gender & Minority Equity Subcommittee of the Council. Responsible for annual reporting to the President with regard to the findings and work of the subcommittee.
∙ Monitor institution's efforts in complying with Title IX measures related to gender equity in athletics including: participation, scholarships, and other benefits (e.g., provision of equipment and supplies, scheduling, travel, tutoring, coaching, locker rooms, facilities, medical and training facilities and services, publicity, recruiting, and support services).

Participation:
∙ Compare the university's enrollment data to the number of athletic participation opportunities it offers;
∙ Review the institution's history of expanding participation opportunities for students of the underrepresented sex; and
∙ Evaluate whether there is unmet interest in a particular sport, whether there is sufficient ability to sustain a team in the sport, and whether there is a reasonable expectation of competition for the team

Scholarships:
∙ Work with the Athletics Department to ensure athletic financial assistance, including athletic scholarships or grants­-in-­aid, is being administered in a manner that provides reasonable opportunities for such awards for members of each sex in substantial proportion to the number of students of each sex participating in interscholastic or intercollegiate athletics.

Additional Duties:
∙ Oversee and assist in reviewing and comparing the distribution of athletic benefits and opportunities by sex in each of the laundry list factors, including financial expenditures on male and female athletic teams.
∙ Ensure equity in the provision of equipment and supplies; scheduling of games and practice time; travel and per diem allowances; opportunity for coaching and academic tutoring; assignment and compensation of coaches and tutors; provision of locker rooms; and practice and competitive facilities; provision of medical and training facilities and services; housing and dining services; publicity; recruitment; and support services.

Training, Education and Communications
∙ Coordinate training, education and preventive measures in the areas of Sex Discrimination, Sexual Harassment, Sexual Violence, Domestic Violence, Dating Violence, and Stalking, and ensuring Sexual Violence victims are notified of the right to file a criminal complaint;
∙ Work with appropriate campus divisions (e.g., University Police, Human Resources, Academic Affairs, and Student Affairs) to provide employees and students education programs and information, as required by Title IX, VAWA/Campus SaVE Act, and other applicable laws;
∙ Provide consultation and information regarding Title IX requirements to potential complainants;
∙ Ensure the Notice of NonDiscrimination on the Basis of Gender or Sex and the Myths and Facts About Sexual Violence are widely published and disseminated as set forth in Executive Order 1095; and
∙ Ensure the written explanation of Rights and Options for Victims of Sexual Violence, Dating Violence, Domestic Violence, and Stalking is provided to all Sexual Violence complainants/victims.

Program Compliance and Administration
∙ Ensure that every person affected by operations of Fresno State – including students, their parents or guardians, employees, and applicants for admission and employment – is aware of the legal rights Title IX affords and that the institution and its officials comply with the legal obligations under Title IX.
∙ Coordinate the institution's responses on all complaints involving possible Title IX violations. This responsibility includes monitoring outcomes, identifying and addressing any patterns, and assessing effects on the campus climate.
∙ Assist in drafting and revising institution's policies and procedures on sex discrimination to help ensure compliance with the requirements of Title IX.
∙ Coordinate the collection and analysis of information from an annual climate survey if, as OCR recommends, the school conducts such a survey.
∙ Monitor and manage Title IX incidents to ensure an efficient and effective response to reports and complaints.
∙ Serve as Title IX investigator for cases alleging sexual assault, sexual misconduct, sexual harassment, relationship violence and stalking;
∙ Ensure a well­-documented Title IX investigative process is established and followed;
∙ Review the outcome of employee and student disciplinary proceedings involving cases of alleged Sex Discrimination, Sexual Harassment, Sexual Violence, Domestic Violence, Dating Violence, and/or Stalking, to determine whether any additional remedies need to be provided to the victim;
∙ Create a committee of employees, students and campus officials to identify strategies for ensuring that employees and students know how to identify and report Sex Discrimination, Sexual Harassment, Sexual Violence, Domestic Violence, Dating Violence, and Stalking, and know what remedies are available to victims;
∙ Regularly assess employee and student activities to ensure that no practices or behaviors violate policies against Sex Discrimination, Sexual Harassment, Sexual Violence, Domestic Violence, Dating Violence, and Stalking, and use the results of such assessments to inform proactive remedial steps;
∙ Identify and address any systemic or other patterns of Sex Discrimination, Sexual Harassment, Sexual Violence,
∙ Domestic Violence, Dating Violence, and Stalking, and implementing corrective measures, as appropriate;
∙ Work in collaboration with campus departments to collect and report required data to the Department of Education and others as appropriate; and
∙ Serve as university expert on Title IX requirements and other sexual discrimination, sexual harassment, and sexual violence statutory and regulatory requirements and provide consultation and advice to the President and Cabinet as necessary.

Knowledge, Skills, & Abilities:
∙ Knowledge of and ability to interpret federal and state laws regarding discrimination, harassment and retaliation. Knowledge of current state and federal laws, regulations, and trends in the field of higher education in the areas of sex discrimination, sexual harassment, sexual violence, and other discriminatory practices that violate Title IX and VAWA. Ability to guide, advise, and support education and training on Title IX and VAWA for a broad campus audience. Exceptional communication and interpersonal skills, including the ability to both be impartial and project impartiality and establish rapport with a diverse range of community members.

Education and Experience:
∙ A bachelor's degree from an accredited college or university in a related field (e.g. Social Work, Psychology or Forensic Psychology, Higher Ed. Administration, or other relevant discipline).
∙ At least three years of progressively responsible experience in complaint resolution, higher education administration, human resources management, or Title IX/ EEO/ADA compliance, including significant experience handling investigations related to sexual harassment, discrimination, and/or sexual violence.
∙ Experience and training regarding conducting sensitive and confidential investigations alleging violations of Title IX or discrimination and harassment.
∙ Must complete relevant CSU annual training on issues related to Sex Discrimination, Sexual Harassment, Sexual Violence, Domestic Violence, Dating Violence, and Stalking.

Preferred Qualifications:
∙ A master's degree or doctorate of jurisprudence.
∙ A minimum of six years' experience in complaint resolution, including significant experience in handling various types of investigations related to sexual harassment, discrimination, and/or Title IX violations.
∙ Experience in a higher education setting.
∙ Knowledge and experience with gender/sexual violence issues and effects of sexual assault on victims, survivor recovery, medical and legal procedures.
∙ Experience with NCAA Division I FBS athletic programs
